As AI systems advance and become more widely used, we are witnessing cases of irresponsible behaviour and unintended severe consequences . This has triggered companies to prioritize the implementation of Responsible AI and governments across the world to establish legal frameworks to govern and use AI responsibly.

Many countries are establishing legal framework for AI. Notably, the EU AI Act is the first to enter into force. Others include Canada AI Act Bill C-11, Singapore’s AI Act, United States, UK, Australia, OECD countries and more.

The EU AI Act has entered into force on the August 1, 2024. AI systems prohibited under the EU AI Act must cease by tFebruary 2, 2025 or face penalties. Enforcement start dates vary depending on the type of AI models and the nature of risks

While the EU AI act applies directly on businesses in the 27 member countries of the EU, businesses that develop or deploy AI systems for use within EU need to comply with EU AI act.

EU AI act is a very comprehensive, legally binding framework that covers both single purpose (AI) and general-purpose AI systems (GPAI).  It applies to organizations that market or use AI.

The EU AI Act has defined four levels of risks: unacceptable risk, high risk, limited risk, and low risk. There are different rules and obligations for different risk levels.

  • Unacceptable Risk: These are prohibited within EU. Social (credit) scoring is an example of unacceptable risk use case.
  • High Risk: This is the focus of regulations. Financial solutions andbiometric identification are some examples of high risk use cases.
  • Limited Risk: The regulations are mainly focused on transparency. Chatbots are an example of limited risk.

Low Risk: Not restricted by regulations. Process optimization is an example of low risk use case.

The regulations like EU AI Act apply to all industries that market or use AI. Highly regulated industries have additional motivation to address ethical concerns, comply with regulations and more importantly continue to innovate within set guardrails.

It aims to mitigate risks and promote beneficial outcomes that could come with AI solutions, while minimizing potential harm to individuals, communities, and society. Embedding ethics that reflects societal and ethical values into business processeshelps create a strong brand reputation with customers, essentially future proofing the organization.

The advancement in AI, particularly GenAI technology, which can create new content brings its own risks and challenges. This has accelerated the importance of Responsible AI and  often discussed in conjunction with GenAI.  However, Responsible AI applies to all AI systems, not just GenAI.
